Did you or a loved one suffer an adverse event after vaccination?

From virtually eliminating the threat of potentially deadly disease to sparing countless individuals needless misery and suffering, the benefits of vaccination are indisputable. While the flu shot, tetanus shot and other vaccinations play a crucial role in the nation’s public health policy and are generally sage, vaccine injuries and adverse events, while exceedingly rare, can and do occur.

Compensation for Vaccine Injury Victims in New York State

While the majority of vaccine side effects are mild and short-lasting, the NVICP pays out tens of millions of dollars to individuals who suffer rare injuries and complications associated with vaccines or vaccine administration every year. This no-fault program was established by the U.S. Congress in 1988 amid concerns that lawsuits targeting vaccine manufacturers would result in shortages and discourage many people from getting vaccinated. Since then, the NVICP has awarded over $4.5 billion to nearly 10,000 claimants.

The NVICP covers most vaccines recommended by the U.S. Centers for Disease Control & Prevention, including:

  • Diphtheria (e.g., DTP, DTaP, Tdap, DT, Td, TT)
  • Haemophilus influenzae type b polysaccharide conjugate vaccines (e.g., Hib)
  • Hepatitis A (e.g., HAV)
  • Hepatitis B (e.g., HBV)
  • Human papillomavirus (e.g., HPV)
  • Seasonal influenza (e.g., Flu Shot)
  • Measles (e.g., MMR)
  • Mumps (e.g., MMR, MR, M)
  • Meningococcal (e.g., MCV4, MPSV4, MenB-FHbp, MenB-4C)
  • Pertussis (e.g., DT, DTaP, Tdap)
  • Pneumococcal conjugate (e.g., PCV)
  • Polio (e.g., OPV or IPV)
  • Rotavirus (e.g., RV)
  • Rubella (e.g., MMR, MR, R)
  • Tetanus (e.g., Td)
  • Varicella/Chickenpox (e.g., VAR)

Eligible adverse events range from injection site complications to neurological injuries resulting in paralysis and, rarely, death. Some of the most common injuries and conditions involved in these claims include:

  • Guillain-Barre Syndrome (GBS)
  • Shoulder injury related to vaccine administration (SIRVA)
  • Acute disseminated encephalomyelitis (ADEM)
  • Transverse myelitis
  • Parsonage-Turner Syndrome (brachial neuritis)
  • Anaphylaxis (severe allergic reaction)
  • Idiopathic thrombocytopenic purpura (ITP)
  • Chronic inflammatory demyelinating polyneuropathy (CIDP)

The NVICP enables vaccine injured individuals and their families to obtain compensation through a streamlined process that eliminates the time and expense of pursuing a personal injury or medical malpractice lawsuit through the civil court systems. Because the Program is a no-fault program, claimants are not required to prove negligence or fault on the part of vaccine manufacturers, healthcare providers, or anyone else.

NVICP petitions must be filed with the United States Court of Federal Claims in Washington, D.C., where all of our New York vaccine lawyers are admitted to practice. Unlike a traditional lawsuit, claimants awarded compensation through the Program do not pay their attorneys a percentage of their compensation awards. Instead, all legal fees can be paid separately by the Court of Federal Claims once a case is resolved.
